TRIPSO Platform Terms and Conditions

§1. General Provisions

These Terms and Conditions define the rules for using the TRIPSO technology platform (hereinafter referred to as the "Platform") provided by TRIPSO sp. z o.o. with its registered office in Lublin, ul. Bohdana Dobrzańskiego 3, 20-262 Lublin, KRS: 0000949370, NIP: 5423444066, REGON: 521051445 (hereinafter referred to as "TRIPSO").

These Terms and Conditions constitute the terms and conditions for the provision of electronic services within the meaning of the Act of 18 July 2002 on the provision of electronic services.

These Terms and Conditions are addressed exclusively to entrepreneurs. The Platform is not intended for consumers.

§2. Nature of the Services

TRIPSO is solely a technology provider and provides the Platform in a SaaS model. The Platform may include, in particular: a chatbot and widgets, a content management system, a website builder, a blog engine and content generator, a review system, a booking engine, and other IT tools.

TRIPSO provides indirect services within the meaning of EU Regulation 2022/2065 (DSA), in particular hosting services.

TRIPSO is not a party to contracts concluded by the Client with its end customers, does not sell travel services, and is not a tour operator, travel intermediary, agent, or payment institution.

§3. Account and Access

The contract is concluded upon creation of an Account and acceptance of the Terms and Conditions or conclusion of a separate agreement.

The Client provides accurate registration data and updates it in the event of any changes.

The Client is responsible for the security of their login details and for all actions performed using their Account.

TRIPSO may refuse to create an Account without providing a reason.

§4. Customer Liability

The Customer is fully and solely responsible for:

the content entered into and published through the Platform;

their business, including its compliance with applicable law and the possession of required permits, concessions, and licenses;

the execution of contracts concluded with their own end customers, handling reservations, returns, and complaints;

maintaining their own privacy policy and terms and conditions, and fulfilling their disclosure obligations towards data subjects;

obtaining all required consents, including marketing and cookie consents;

the content and authenticity of reviews collected and published through the Platform.

The Customer shall not enter illegal content, content that infringes the rights of third parties, or that is misleading, into the Platform, nor shall they engage in any activity that disrupts the operation of the Platform (including reverse engineering, bypassing security measures, or prompt injection).

TRIPSO may remove or block access to any content upon receipt of credible information about its illegal nature or in the event of a violation of these Terms and Conditions.

Reports of unlawful content are accepted at abuse@tripso.ai.

§5. AI Content

The Platform uses artificial intelligence models provided by third parties (including Anthropic, OpenAI, Google) to generate content, including chatbot responses.

AI-generated content is for informational purposes only, may contain errors or be outdated, and does not constitute declarations of intent or binding offers.

The Client verifies and moderates AI content before publishing it or sending it to third parties and informs users that they are interacting with artificial intelligence, in accordance with EU Regulation 2024/1689 (AI Act).

TRIPSO is not responsible for decisions made based on AI content.

§6. Intellectual Property

The Platform, including its software, interfaces, documentation, and trademarks, are the exclusive property of TRIPSO or its licensors.

Upon conclusion of the agreement, TRIPSO grants the Client a non-exclusive, non-transferable license to use the Platform solely within the scope and for the period specified in the agreement.

Content entered by the Client remains the Client's property. The Client grants TRIPSO a non-exclusive, royalty-free license to use it to the extent necessary to provide the Services.

§7. Personal Data Protection

The principles of personal data processing are described in the Privacy Policy available at https://tripso.ai/privacy.

With respect to the Client's end-customer data processed within the Platform, TRIPSO acts as a processor within the meaning of Article 28 of the GDPR; the Client is the controller of this data. The terms of such processing are specified in a separate data processing agreement (DPA).

§8. Availability and Operation of the Platform

TRIPSO endeavors to ensure the proper operation of the Platform, but does not guarantee its uninterrupted or error-free availability.

TRIPSO may conduct maintenance, updates, and modifications to the Platform.

TRIPSO is not liable for unavailability resulting from third-party actions, supplier failures (hosting, AI models, telecommunications operators), force majeure, or use of the Platform in violation of the Terms of Service.

§9. Limitation of Liability

To the fullest extent permitted by law, TRIPSO is not liable for:
